D\u00f6nem Toplu S\u00f6zle\u015fme ile birlikte imza alt\u0131na al\u0131nan, 13 Ocak 2023 tarihinde ise TBMM&#8217;ye sunulan kamuda \u00e7al\u0131\u015fan 458 bin 615 S\u00f6zle\u015fmeli Personelin Kadroya ge\u00e7irilmesini de i\u00e7eren kanun teklifi T\u00fcrkiye B\u00fcy\u00fck Millet Meclisi Genel Kurulu&#8217;nda kabul edildi. D\u00fczenlemeyle 28 Kas\u0131m 2022&#8217;den \u00f6nce s\u00f6zle\u015fmeli olarak g\u00f6reve ba\u015flayanlar, herhangi bir bekleme s\u00fcresine tabi olmadan, do\u011frudan bulunduklar\u0131 kurumlarda memur kadrosuna ge\u00e7ebilecek. Bu kapsamdakilerin, memurlu\u011fa ge\u00e7melerinin ard\u0131ndan 1 y\u0131l s\u00fcreyle ayn\u0131 kadroda \u00e7al\u0131\u015ft\u0131ktan sonra tayin hakk\u0131n\u0131 elde edebilecekler. 458 bin 615 s\u00f6zle\u015fmeli personel; g\u00f6revde y\u00fckselme, unvan de\u011fi\u015fikli\u011fi, memuriyet g\u00fcvencesi ve tayin imkan\u0131 gibi haklara sahip olacak.<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif; font-size: 14px;\">Kadroya ge\u00e7i\u015fler iste\u011fe ba\u011fl\u0131 olacak. Kadroya ge\u00e7mek istemeyen s\u00f6zle\u015fmeli personel haklar\u0131, personelin g\u00f6revi sona erene kadar \u015fahsa ba\u011fl\u0131 olarak korunacak. 4B&#8217;li personel, mahalli idareler personeli, te\u015fkilat kanunlar\u0131na dayal\u0131 \u00e7al\u0131\u015fan s\u00f6zle\u015fmeli personel, K\u00fclt\u00fcr ve Turizm Bakanl\u0131\u011f\u0131 sanat\u00e7\u0131lar\u0131, kamu d\u0131\u015f\u0131 aile sa\u011fl\u0131\u011f\u0131 \u00e7al\u0131\u015fanlar\u0131, vekil imam, hatip ve m\u00fcezzin kayyumlar ile vekil ebe ve hem\u015fireler de d\u00fczenlemenin kapsam\u0131nda yer al\u0131yor. Daha \u00f6nce \u00e7al\u0131\u015fman\u0131n kapsam\u0131na dahil edilen 50-D&#8217;li ara\u015ft\u0131rma g\u00f6revlileri ise, Y\u00fcksek \u00d6\u011fretim Kurulunun haz\u0131rlayaca\u011f\u0131 ba\u015fka bir \u00e7al\u0131\u015fmaya dahil edilece\u011fi gerek\u00e7esiyle s\u00f6z konusu d\u00fczenleme kapsam\u0131ndan \u00e7\u0131kar\u0131lm\u0131\u015ft\u0131.<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif; font-size: 14px;\">Kamu hizmetlerinde aksama ya\u015fanmamas\u0131 i\u00e7in kadroya ge\u00e7ecek mahalli idareler personeli, yaln\u0131zca mahalli idareler aras\u0131nda nakil yapabilecek. Di\u011fer s\u00f6zle\u015fmeli personel ise s\u00f6zle\u015fmeli stat\u00fcdeki s\u00fcrelere dahil 4 y\u0131ll\u0131k hizmetini doldurduktan sonra nakil hakk\u0131na sahip olabilecek. \u0130stihdam edilecek s\u00f6zle\u015fmeli personel bak\u0131m\u0131ndan Devlet Memurlar\u0131 Kanunu&#8217;nun 4B maddesi 3+1 modeline g\u00f6re yeniden d\u00fczenlenecek. D\u00fczenleme y\u00fcr\u00fcrl\u00fc\u011fe girdikten sonra kamuya giren s\u00f6zle\u015fmeli personel, 3 y\u0131l g\u00f6rev yapt\u0131ktan sonra memur kadrolar\u0131na atanacak. Atand\u0131ktan sonra da 1 y\u0131l s\u00fcreyle kurum i\u00e7i veya kurumlar aras\u0131 nakil yasa\u011f\u0131na tabi olacak. B\u00f6ylece hem s\u00f6zle\u015fmeli personelin art\u0131k kadro problemi olmayacak hem de kamu hizmetleri aksamadan i\u015fleyecek.<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif; font-size: 14px;\">Mahalli idarelerde g\u00f6rev yapan s\u00f6zle\u015fmeli personel 3 y\u0131l\u0131n sonunda kadroya ge\u00e7ece\u011fi i\u00e7in mahalli idarelerdeki s\u00f6zle\u015fmeli personel istihdam\u0131 i\u00e7in memurlar gibi KPSS zorunlulu\u011fu getirilecek. Ayr\u0131ca s\u00f6zle\u015fmeli personel ile memurlarda uyguland\u0131\u011f\u0131 gibi disiplin ve g\u00f6revden uzakla\u015ft\u0131rmaya ili\u015fkin h\u00fck\u00fcmler getirilerek stat\u00fcler aras\u0131nda uyum sa\u011flanacak. Personel s\u00f6zle\u015fmelerinde 3 y\u0131ldan sonra kadroya ge\u00e7me imkan\u0131 olmayan belediyelerde di\u011fer kamu personellerinde oldu\u011fu gibi yap\u0131lan s\u00f6zle\u015fmeler de 3+1 sistemine dahil edilecek.
