Bu \u015fartlar aras\u0131nda zemin et\u00fct raporlar\u0131, fay hatt\u0131 ara\u015ft\u0131rmalar\u0131, depreme dayan\u0131kl\u0131l\u0131k raporlar\u0131 ve ilave kat yap\u0131lm\u0131\u015fsa teknik rapor al\u0131nmas\u0131 gibi ko\u015fullar bulunuyor&#8221; dedi.<\/span><\/strong><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif; font-size: 14px;\">\u0130mar kanununda de\u011fi\u015fiklik yap\u0131lmas\u0131na ili\u015fkin kanun teklifi, TBMM Bay\u0131nd\u0131rl\u0131k, \u0130mar, Ula\u015ft\u0131rma Ve Turizm Komisyonu\u2019nda de\u011ferlendirilecek. Kanun teklifine ili\u015fkin olarak de\u011ferlendirmelerde bulunan Alt\u0131n Emlak Global Genel M\u00fcd\u00fcr\u00fc Mustafa Hakan \u00d6zelmac\u0131kl\u0131, \u201cTeklif ki\u015finin kendi arazisine 31.12.2023 tarihinden \u00f6nce yapm\u0131\u015f oldu\u011fu ruhsats\u0131z ve ruhsata ayk\u0131r\u0131 yap\u0131lar i\u00e7in afet risklerine dayan\u0131kl\u0131l\u0131k \u015fart\u0131yla Yap\u0131 Kay\u0131t Belgesi verilmesini ve Hazineye ait ta\u015f\u0131nmazlar \u00fczerine yap\u0131lm\u0131\u015f belgeli yap\u0131lar\u0131n sat\u0131\u015f s\u00fcresinin uzat\u0131lmas\u0131n\u0131 \u00f6ng\u00f6r\u00fcyor. Kanun teklifi gerek\u00e7elerinde ise \u00f6zellikle g\u00fcncel olmayan uydu g\u00f6r\u00fcnt\u00fcleri ile ma\u011fduriyetler olu\u015ftu\u011fu, k\u00f6ylerin mahalle stat\u00fcs\u00fcne ge\u00e7mesi nedeniyle de bu yap\u0131lar\u0131n ruhsats\u0131z duruma d\u00fc\u015ft\u00fc\u011f\u00fc de\u011ferlendiriliyor. Teklif \u00f6zellikle yap\u0131n\u0131n depreme dayan\u0131kl\u0131l\u0131\u011f\u0131n\u0131 belirli \u015fartlar\u0131 kar\u015f\u0131layan yap\u0131lar\u0131n kapsam\u0131na al\u0131nmas\u0131 hedefliyor. Bu \u015fartlar aras\u0131nda zemin et\u00fct raporlar\u0131, fay hatt\u0131 ara\u015ft\u0131rmalar\u0131, depreme dayan\u0131kl\u0131l\u0131k raporlar\u0131 ve ilave kat yap\u0131lm\u0131\u015fsa teknik rapor al\u0131nmas\u0131 gibi ko\u015fullar bulunuyor\u201d dedi.<\/span><\/p>\n<p><strong><span style=\"font-family: arial, helvetica, sans-serif; font-size: 14px;\">&#8221;Uydu g\u00f6r\u00fcnt\u00fclerinde eksikler ve uygulamada farkl\u0131klar ya\u015fanm\u0131\u015f&#8221;<\/span><\/strong><br \/>\n<span style=\"font-family: arial, helvetica, sans-serif; font-size: 14px;\">Daha \u00f6nce \u00e7\u0131kart\u0131lan \u0130mar bar\u0131\u015f\u0131ndan faydalanman\u0131n ilk \u015fart\u0131n\u0131n yap\u0131n\u0131n 31.12.2017 tarihinden \u00f6nce yap\u0131lm\u0131\u015f olmas\u0131 oldu\u011funu hat\u0131rlatan \u00d6zelmac\u0131kl\u0131, \u201cBaz\u0131 raporlarda \u0130mar bar\u0131\u015f\u0131 s\u00fcrecinde uydu, ortofoto veya \u00e7e\u015fitli programlarla sa\u011flanm\u0131\u015f g\u00f6r\u00fcnt\u00fclerin do\u011fru sonu\u00e7 vermedi\u011fi belirlenmi\u015fti. \u00d6zellikle k\u0131rsal b\u00f6lgelerde uydu verilerinin g\u00fcncelli\u011fi ve tam do\u011frulu\u011fu da sa\u011flanamam\u0131\u015ft\u0131. Ayr\u0131ca esaslarda Yap\u0131 Kay\u0131t Belgesi verilmesine ili\u015fkin i\u015f ve i\u015flemlerin Bakanl\u0131k taraf\u0131ndan denetlenece\u011fi h\u00fck\u00fcm alt\u0131na al\u0131nsa da, bu denetlemenin nas\u0131l ve ne zaman yap\u0131laca\u011f\u0131 da a\u00e7\u0131klanmam\u0131\u015ft\u0131. Bu konularda da uygulama farkl\u0131klar\u0131 nedeniyle ya\u015fanan ma\u011fduriyetler olmu\u015f, Yap\u0131 Kay\u0131t Belgesi iptali nedeniyle a\u00e7\u0131lan davalar\u0131n kaybedilmesi sonucunda mahkeme giderlerinin olu\u015ftu\u011fu ve bu giderlerin bakanl\u0131k b\u00fct\u00e7esinden kar\u015f\u0131land\u0131\u011f\u0131 \u00e7e\u015fitli raporlarda yer alm\u0131\u015ft\u0131\u201d \u015feklinde konu\u015ftu.<\/span><\/p>\n<p><strong><span style=\"font-family: arial, helvetica, sans-serif; font-size: 14px;\">&#8221;Ma\u011fduriyetler \u00e7\u00f6z\u00fclmeli lakin sa\u011fl\u0131ks\u0131z yap\u0131la\u015fmaya f\u0131rsat vermemeli&#8221;<\/span><\/strong><br \/>\n<span style=\"font-family: arial, helvetica, sans-serif; font-size: 14px;\">\u0130mar bar\u0131\u015flar\u0131n\u0131n \u015fehirlerimizin afetlere kar\u015f\u0131 savunmas\u0131z ve sa\u011fl\u0131ks\u0131z bir \u015fekilde b\u00fcy\u00fcmesine neden oldu\u011funa dikkat \u00e7eken \u00d6zelmac\u0131kl\u0131, \u201c\u0130mar bar\u0131\u015f\u0131, ka\u00e7ak yap\u0131la\u015fmay\u0131 te\u015fvik ediyor, kentsel d\u00f6n\u00fc\u015f\u00fcme engel oluyor. Kanunlara uygun \u015fekilde yap\u0131 in\u015fa edenler cezaland\u0131r\u0131l\u0131rken, kanunsuz faaliyetlerde bulunanlar \u00f6d\u00fcllendiriliyor. Bu konuda yasal d\u00fczenlemeler net olmal\u0131\u201d diye konu\u015ftu.<\/span><\/p>\n<p><strong><span style=\"font-family: arial, helvetica, sans-serif; font-size: 14px;\">Belediyeler Toprak Koruma ve Arazi Kullan\u0131m\u0131 Kanunu kapsam\u0131nda hareket etmeli<\/span><\/strong><br \/>\n<span style=\"font-family: arial, helvetica, sans-serif; font-size: 14px;\">\u00d6zellikle baz\u0131 belediyeler taraf\u0131ndan tar\u0131m arazilerine tar\u0131m d\u0131\u015f\u0131 ama\u00e7la kullan\u0131m izinleri verildi\u011fini ifade eden \u00d6zelmac\u0131kl\u0131, \u201c5403 say\u0131l\u0131 Toprak Koruma ve Arazi Kullan\u0131m\u0131 Kanunun 13. maddesine g\u00f6re, imar planlar\u0131nda tar\u0131msal niteli\u011fi korunacak alan olarak belirlenen ve kamu yarar\u0131 g\u00f6zetilerek tar\u0131m d\u0131\u015f\u0131 ama\u00e7larla kullan\u0131m izni verilen yerler, bu ama\u00e7 d\u0131\u015f\u0131nda kullan\u0131lamaz veya planlanamaz h\u00fckm\u00fc bulunmaktad\u0131r. Bu konuda baz\u0131 belediyeler taraf\u0131ndan verilen izin, ruhsat ve imar durumlar\u0131na ili\u015fkin kararlarda, tar\u0131msal niteli\u011fi korunacak alanlar \u00fczerinde Bakanl\u0131k g\u00f6r\u00fc\u015f\u00fc al\u0131nmadan da i\u015flemler yap\u0131labiliyor.
