Y\u00fcksek Mahkeme, apartman y\u00f6neticisinin i\u015fveren temsilcisi oldu\u011funa dikkat \u00e7ekti.<br \/>\n<\/span><\/strong><br \/>\n<span style=\"font-family: arial, helvetica, sans-serif; font-size: 14px;\">Tam 7 senedir kap\u0131c\u0131 olarak \u00e7al\u0131\u015ft\u0131\u011f\u0131 siteden kovulan kap\u0131c\u0131 M.S., \u0130\u015f Mahkemesi&#8217;nin yolunu tuttu. Davac\u0131 kap\u0131c\u0131, sigortas\u0131z \u00e7al\u0131\u015ft\u0131r\u0131ld\u0131\u011f\u0131n\u0131, k\u0131dem ve ihbar tazminatlar\u0131 ile \u00fccret, fazla \u00e7al\u0131\u015fma, y\u0131ll\u0131k izin, hafta tatili, ulusal bayram ve genel tatil \u00fccreti ve asgari ge\u00e7im indirimi alacaklar\u0131n\u0131n tahsiline karar verilmesini talep etti. Daval\u0131 apartman y\u00f6neticisi M.S.U. da davac\u0131n\u0131n i\u015ften ayr\u0131ld\u0131\u011f\u0131n\u0131, davac\u0131ya bir k\u0131s\u0131m tazminat \u00f6denmesi konusunda anla\u015f\u0131ld\u0131\u011f\u0131n\u0131 ve bir miktar \u00f6deme yap\u0131ld\u0131\u011f\u0131n\u0131 dile getirdi. Bir s\u00fcre sonra Site Y\u00f6netiminin duyulan ihtiya\u00e7 \u00fczerine tekrar i\u015f\u00e7i al\u0131m\u0131 yapmak i\u00e7in i\u015f ba\u015fvurular\u0131n\u0131 kabul etmeye ba\u015flad\u0131\u011f\u0131n\u0131, bu durumu haber alan davac\u0131n\u0131n yeniden i\u015f ba\u015fvurusunda bulunaca\u011f\u0131n\u0131 s\u00f6yleyerek aramas\u0131 \u00fczerine i\u015fyerine davet edildi\u011fini ancak davac\u0131n\u0131n SGK\u2019ya \u015fik\u00e2yette bulundu\u011funu ve i\u015fyerinde sigortas\u0131z \u00e7al\u0131\u015f\u0131yor gibi tutanak tutturdu\u011funu \u00f6ne s\u00fcrd\u00fc. Bu nedenle tazminat\u0131n geri kalan\u0131n \u00f6denmedi\u011fini, fazla \u00e7al\u0131\u015fmas\u0131n\u0131n bulunmad\u0131\u011f\u0131n\u0131, di\u011fer alacak taleplerinin haks\u0131z oldu\u011funu beyanla davan\u0131n reddini istedi.<\/span><br \/>\n<span style=\"font-family: arial, helvetica, sans-serif; font-size: 14px;\">Mahkeme, kap\u0131c\u0131lar\u0131n apartman y\u00f6neticisine kar\u015f\u0131 da dava a\u00e7\u0131labilece\u011fi ancak bu h\u00e2lde h\u00fckm\u00fcn y\u00f6netici hakk\u0131nda de\u011fil kat malikleri hakk\u0131nda kurulmas\u0131 gerekti\u011fine dikkat \u00e7ekti. Davac\u0131n\u0131n talep konusu i\u015f\u00e7ilik alacaklar\u0131n\u0131n \u00f6dendi\u011fini ispata y\u00f6nelik daval\u0131 i\u015fverence herhangi bir delil sunulmad\u0131\u011f\u0131, feshe ili\u015fkin ispat y\u00fck\u00fc \u00fczerinde olan daval\u0131n\u0131n feshin ge\u00e7erli yahut hakl\u0131 bir sebebe dayand\u0131\u011f\u0131n\u0131 ispat edemedi\u011fi gerek\u00e7e g\u00f6sterilerek davan\u0131n k\u0131smen kabul\u00fcne karar verildi. Karar\u0131 daval\u0131 site y\u00f6netimi karar\u0131 istinafa g\u00f6t\u00fcrd\u00fc. B\u00f6jlge Adliye Mahkemesi, mahkemenin mevcut \u015fekilde karar verilmesinin usul ve kanuna ayk\u0131r\u0131 oldu\u011fundan bahisle \u0130\u015f Mahkemesi karar\u0131n\u0131 ortadan kald\u0131rd\u0131.<\/span><br \/>\n<span style=\"font-family: arial, helvetica, sans-serif; font-size: 14px;\">Karar\u0131 davac\u0131 temyiz edince devreye Yarg\u0131tay 9. Hukuk Dairesi girdi. Y\u00f6neticinin, i\u015f kanunlar\u0131 ve Y\u00f6netmelik\u2019in uygulanmas\u0131 y\u00f6n\u00fcyle i\u015fveren temsilcisi oldu\u011funun vurguland\u0131\u011f\u0131 Yarg\u0131tay karar\u0131nda; i\u015f hukuku anlam\u0131nda ortaya \u00e7\u0131kabilecek idari ve yarg\u0131sal uyu\u015fmazl\u0131klarda y\u00f6neticinin i\u015fvereni temsil edece\u011fi hat\u0131rlat\u0131ld\u0131. Kararda \u015f\u00f6yle denildi: &#8220;Bu itibarla, kap\u0131c\u0131n\u0131n i\u015fveren hakk\u0131nda a\u00e7abilece\u011fi davan\u0131n kat maliki ya da maliklerine kar\u015f\u0131 a\u00e7\u0131lmas\u0131 gerekmekte ise de Y\u00f6netmelik\u2019ten do\u011fan bu temsil yetkisine g\u00f6re davan\u0131n do\u011frudan y\u00f6netici has\u0131m g\u00f6sterilerek a\u00e7\u0131lmas\u0131 da m\u00fcmk\u00fcnd\u00fcr. Ancak bu h\u00e2lde dahi h\u00fckm\u00fcn do\u011frudan y\u00f6netici hakk\u0131nda kurulmas\u0131 do\u011fru de\u011fildir. Mahkemece kat maliki ya da malikleri ad\u0131na y\u00f6netici hakk\u0131nda karar verilmesi gerekir. Somut uyu\u015fmazl\u0131kta davac\u0131n\u0131n, i\u015f\u00e7ilik alacaklar\u0131na ili\u015fkin dava \u015fart\u0131 arabuluculuk ba\u015fvurusunda kat maliki M. S. \u2018nu taraf g\u00f6sterdi\u011fi, arabuluculuk g\u00f6r\u00fc\u015fmelerinin davac\u0131 ile kat maliki M. S. aras\u0131nda yap\u0131ld\u0131\u011f\u0131 ancak davac\u0131n\u0131n konut kap\u0131c\u0131s\u0131 olarak \u00e7al\u0131\u015ft\u0131\u011f\u0131n\u0131 ileri s\u00fcrd\u00fc\u011f\u00fc ta\u015f\u0131nmaz\u0131n tek malikinin M. S. olmad\u0131\u011f\u0131 ortadad\u0131r. 33 ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmden olu\u015fan s\u00f6z konusu ta\u015f\u0131nmaz\u0131n 15 ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn\u00fcn M. S. \u2018na ait oldu\u011fu, davac\u0131 ile kat maliki M. S. aras\u0131nda yap\u0131lan arabuluculuk g\u00f6r\u00fc\u015fmelerinin anla\u015famama ile sonu\u00e7lanmas\u0131 \u00fczerine site y\u00f6netimi aleyhine husumet y\u00f6neltilerek dava a\u00e7\u0131ld\u0131\u011f\u0131, kat maliki M. S. taraf\u0131ndan daval\u0131 y\u00f6netim ad\u0131na davaya cevap dilek\u00e7esi verilmi\u015f ise de karar defterine g\u00f6re davac\u0131n\u0131n \u00e7al\u0131\u015ft\u0131\u011f\u0131 ta\u015f\u0131nmaz\u0131n y\u00f6neticisinin dava d\u0131\u015f\u0131 M. S.U. oldu\u011fu anla\u015f\u0131lm\u0131\u015ft\u0131r. Ayr\u0131ca 634 say\u0131l\u0131 Kanun\u2019un 20 nci maddesinin (a) bendi dikkate al\u0131nd\u0131\u011f\u0131nda dava konusu alacaklardan kat maliklerinin e\u015fit olarak sorumlu olmas\u0131 gerekti\u011fi sabittir. Ancak 634 say\u0131l\u0131 Kanun\u2019un 1 inci maddesinde kat malikinin; ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmler \u00fczerinde kurulan m\u00fclkiyet hakk\u0131na sahip olanlar \u015feklinde tan\u0131mland\u0131\u011f\u0131 ve kat m\u00fclkiyetine konu ta\u015f\u0131nmazdaki ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerden her birinin ayr\u0131 ayr\u0131 el birli\u011fi ve payl\u0131 m\u00fclkiyete konu olabilece\u011fi d\u00fc\u015f\u00fcn\u00fcld\u00fc\u011f\u00fcnde e\u015fit sorumlulu\u011fun her bir ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm y\u00f6n\u00fcnden bulundu\u011fu hususu g\u00f6zden ka\u00e7\u0131r\u0131lmamal\u0131d\u0131r.
